Private Entrepreneur - natural person Eduard Baghirov,
acting on the basis of the registration certificate #385-8959, granted by
Podil district in Kyiv State Administration (hereinafter - "Contractor"),
in the person of his charge-d'affaires - Mykola Kolisnychenko, acting on
the basis of power of attorney #BAK 731905 from June 10, 2003, and

(hereinafter - "Client"), hereinafter separately as "Party" and
jointly as the "Parties", have concluded this Agreement on the following:
1. SUBJECT:
1.1. Client pays for the following:
- Contractor
provides technical and consultation assistance in publishing of the
information of the Client on the site of the Contractor
(www.blackpage.com.ua) (hereinafter as "Site");
- Contractor Publishes
on the Site Client's information materials on the violation of Client's
rights and legal interests, stated in the European Declaration on the
human rights and other national and international normative acts
(hereinafter - "Materials").
1.2. Client, as the citizen of Ukraine or
other State or person without the citizenship, gives Materials and signed
application-commission to Contractor with the purpose of publishing of
Materials on Site.
2. COMPENSATION AND METHOD OF PAYMENT:
2.1. In compensation of the services (indicated in1.1)
rendered by the Contractor Client shall pay a fee in the amount of EURO
"30" (thirty).
2.2. Client shall not pay for the technical support and
other costs of publishing of Materials.
2.3. The sum, indicated in 2.1, shall be paid by Client
within three working days, starting from the next day of giving of the
signed application-commission and publishing of Materials on Site.
2.4. Client shall pay a fee in the amount of EURO "50"
(fifty) after giving of the signed application-commission about removing
of Materials from Site within tree bank days.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES:
3.1. Client has a right to:
3.1.1. Remove published
Materials from Site ahead of time;
3.1.2. Get information and
consultations from Contractor to enjoy the services provided by the
Contractor in necessary volume.
3.2. Client is obliged to:
3.2.1. Give only reliable
Materials for Contractor to publish them on Site; br> 3.2.2. Pay for
services, provided by Contractor, in terms, indicated in 2.3 and 2.4 of
this Agreement. The payment shall be indicated in a proper financial
documents.
3.4. Contractor has a right to:
3.3.1. Verify
authenticity of bank properties of Client;
3.3.2. Stop or suspend to
provide services according to this agreement completely or in part:
-
if Contractor considers Clients Materials to do harm or can do harm to
Contractor or to other Clients or to normal functioning of Site;
- in
case of disregard of provisions, indicated in 2.3 and 2.4 of this
Agreement.
3.5. Contractor is obliged to:
3.4.1. Publish
Client's Materials on Site, without changes and additions, within three
working days after signing of this Agreement;
3.4.2. Render to Client
necessary consultations on the publishing of Client's Materials on Site.
4. LIABILITIES OF THE PARTIES:
4.1. Contractor is not liable for:
4.1.1. Any damage
caused by Client as a result of enjoying of services, provided by
Contractor;
4.1.2. The content of Client's Materials;
4.1.3.
Technical state of Site (hosting of a provider).
4.2. Client is liable for:
4.2.1. Breaking of
legislation in force as a result of publishing of Client's Materials on
Site;
4.2.2. Non-fulfillment or inappropriate fulfillment of terms and
methods of payment for services, provided by Contractor according to this
Agreement.
5. TERM:
5.1. This Agreement shall commence of the date of signing
and fulfillment of point 2.3 of this Agreement.
5.2. This agreement shall remain in force until the
moment of Client's application with application-commerce about removing of
Client's Materials from Site and full completion of payment according to
point 2.4 of this Agreement.
6. FINAL PROVISIONS:
6.1. This Agreement is concluded in two authentic copies
in English: the first one for Contractor and the second one for Client.
6.3. All additions, additional agreements, improvements
and corrections of this Agreement, formalized by authorized
representatives in a proper way shall be Agreement's essentials.
